1. About Habit Hustle

Habit Hustle is a skill-based health challenge platform operated by Dreaded Software LLC (“Company,” “we,” “us,” or “our”). The platform enables users to voluntarily invest money into reducing their own screen time or problematic app usage over a six-week sprint (“Hustle”). Success is determined entirely by a participant’s own effort and measured against personal usage goals derived from their own baseline data. There is no element of chance — your outcome depends solely on your behavior.

Habit Hustle is a contest of skill, not a gambling or lottery product. These Terms govern your access to and use of the Habit Hustle platform, including the website, mobile applications, and any related services (collectively, the “Service”).

2. Eligibility

• You must be at least 18 years of age to use the Service.
• The Service is currently available to residents of the United States only. Access from outside the US is not permitted and may be geo-restricted.
• You must have the legal capacity to enter into a binding agreement.
• You may not create more than one account per person.
• By using the Service, you represent and warrant that you meet all eligibility requirements.

3. Account Registration

You register for an account using a supported OAuth provider (Google, Microsoft, or Facebook). You are responsible for maintaining the security of your account and for all activity that occurs under your account. You agree to notify us immediately at support@habithustle.online if you suspect unauthorized access.

4. How Hustles Work

A Hustle is a six-week skill-based health challenge. Here is how participation works:

• Baseline audit: Before joining a Hustle, your last 14 days of screen-time data is analyzed to generate personalized weekly usage goals. Goals are derived from your own baseline — they are realistic targets calibrated to your actual habits, not arbitrary limits imposed by the platform.
• Entry investment: To join a Hustle, you invest a fixed entry fee (denominated in Hustle Tokens, which correspond to real money) into a shared pot with other participants in the same group (up to 30 people per group).
• Weekly goals: Each week you must meet your personalized screen-time reduction targets. Progress is tracked via screen-time data submitted to the platform.
• Winning: Participants who meet their goals for all six weeks are deemed winners. Winners split the total pot in proportion to their streak multipliers, after the platform fee is deducted (see Section 5).
• Missing goals: If you fail to meet your weekly goals, you are eliminated from that Hustle. Your entry investment remains in the pot and is redistributed to winners. Missing a goal is not a punishment — it means you chose the challenge and the outcome was outside your goal range this time.

5. Platform Fee & Payouts

• Standard Hustles (Free tier): A platform fee of 15% of the gross pot is retained by Habit Hustle. The remaining 85% is distributed to winners.
• Premium-member-only Hustles: No platform fee applies. 100% of the pot is returned to successful investors.
• Payouts are processed via Stripe to your connected payout account. Processing times are subject to Stripe’s standard timelines (typically 2–7 business days).
• We reserve the right to adjust the platform fee structure with 30 days’ advance notice posted on the platform.

6. Refund & Withdrawal Policy

• Before a Hustle starts: You may withdraw your entry investment and receive a full refund up until the Hustle start date.
• After a Hustle starts: Entry investments are non-refundable once the Hustle’s first week has begun.
• Winnings: Winnings credited to your account balance are withdrawable at any time. Minimum withdrawal amount and processing fees may apply.
• In the event that a Hustle is cancelled by Habit Hustle before it begins, all entry investments will be refunded in full.

7. Membership Tiers

Habit Hustle offers a Free tier and a Premium membership. Premium members receive unlimited simultaneous Hustles, higher investment limits, access to 0%-fee Premium-only Hustles, advanced analytics, and other benefits described on the pricing page. Premium subscriptions are billed monthly or annually and may be cancelled at any time. Unused subscription time is non-refundable except as required by applicable law.

8. Prohibited Conduct

You agree not to:

• Submit false, fabricated, or manipulated screen-time data.
• Create multiple accounts to circumvent platform rules or limits.
• Use the platform if you are under 18 or outside the US.
• Attempt to reverse-engineer, scrape, or exploit the platform.
• Harass, abuse, or harm other community members.
• Use the platform in violation of any applicable law or regulation.

Violation of these rules may result in immediate account suspension and forfeiture of any balance.

9. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time via your profile settings or by contacting support. Upon termination, any pending Hustle entry investments that have not yet started will be refunded; investments in active Hustles are subject to the refund policy in Section 6.

10. Disclaimers

The Service is provided “as is” and “as available” without warranty of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free from harmful components. Habit Hustle is a personal behavior-change tool and is not a substitute for medical or mental health advice.

11. Limitation of Liability

To the maximum extent permitted by law, Dreaded Software LLC and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total amount you paid us in the twelve months preceding the claim or (b) $100 USD.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or an in-app notice at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
